TERMS AND CONDITIONS — CVPIDCLUB

1. COMPANY INFORMATION

This online store is operated by CVPIDCLUB, Tax ID: [XXXXXXXX], contact email: cvpidclub@gmail.com. The store runs on the Shopify platform.

2. SCOPE AND ACCEPTANCE

By placing an order on this website, you fully and unconditionally accept these Terms and Conditions as published at the time of purchase. If you do not agree, please refrain from making a purchase.

CVPidClub reserves the right to modify these Terms and Conditions at any time. The version in force at the time of each order shall apply.

3. PURCHASE PROCESS AND CONTRACT FORMATION

The sales contract between CVPidClub and the customer is concluded at the moment CVPidClub sends an order confirmation email. Placing an order does not constitute acceptance on our part.

CVPidClub reserves the right to refuse or cancel any order for reasons including but not limited to:

- Pricing or product description errors
- Suspected fraud or misuse
- Payment processing failure
- Stock unavailability not yet reflected in real time
- Orders of an extraordinary nature exceeding normal personal consumption

In the event of cancellation, a full refund of the amount paid will be issued. No additional compensation shall be owed.

4. PRICES AND PAYMENT

All prices shown include applicable VAT in accordance with Spanish law. Shipping costs are displayed separately before order confirmation.

CVPidClub reserves the right to modify prices at any time. The price applicable is always the one in force at the time of order confirmation.

Accepted payment methods are those enabled on the platform at any given time. CVPidClub does not store card data; payments are processed by PCI-DSS certified payment gateways. If payment is declined, the order will be automatically cancelled.

5. SHIPPING AND DELIVERY

Delivery timeframes shown are estimates and may vary due to circumstances beyond CVPidClub's control (carrier delays, customs, force majeure). CVPidClub is not liable for delays attributable to the shipping carrier or to extraordinary circumstances.

Risk of loss or damage transfers to the customer upon delivery. From that moment, CVPidClub is not responsible for any damage, loss, or deterioration of the product.

If the customer is absent at delivery, it is their responsibility to arrange redelivery or collection from a collection point. Any costs arising from non-collection and return to sender will be deducted from any applicable refund.

6. RIGHT OF WITHDRAWAL AND RETURNS

In accordance with Royal Legislative Decree 1/2007 (TRLGDCU), consumers have 14 calendar days from receipt of their order to exercise the right of withdrawal, without needing to provide a reason.

For a return to be accepted, ALL of the following conditions must be met:

- The product must be in perfect condition, unworn, unwashed, and undamaged
- All original tags must be correctly attached
- The product must be returned in its original or equivalent protective packaging
- Personalised items, limited-edition items marked as non-returnable, and intimate hygiene items (if applicable) are excluded from the right of withdrawal

Return shipping costs are the customer's responsibility, unless the product has a manufacturing defect attributable to CVPidClub.

Refunds will be processed within 14 days of receiving and verifying the returned item, using the same payment method as the original purchase. CVPidClub reserves the right to withhold the refund until the product has been physically received and its condition verified.

Returns initiated outside the legal timeframe or not meeting the above conditions will not be accepted.

7. WARRANTIES AND DEFECTS

Products are covered by the 3-year legal conformity guarantee established by Royal Legislative Decree 1/2007 for contracts entered into from 1 January 2022. This warranty covers manufacturing defects existing at the time of delivery only — not normal wear and tear, improper washing, or customer-caused damage.

To make a warranty claim, customers must contact CVPidClub with photographs of the defect and their order number. CVPidClub will assess each case and may choose, at its sole discretion, to repair, replace, or refund the defective product.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, CVPidClub shall not be liable for:

- Indirect damages, loss of profits, data loss, or consequential losses arising from use or inability to use the products
- Delays or failures due to force majeure (strikes, natural disasters, pandemics, supply failures, government restrictions, or other circumstances beyond CVPidClub's reasonable control)
- Typographical errors in prices or product descriptions, which may be corrected at any time without obligation to honour the erroneous price or description
- Misuse of products by the customer

CVPidClub's total liability to the customer in any case shall be limited to the amount actually paid for the order in question.

9. INTELLECTUAL PROPERTY

All content on this store — including but not limited to designs, logos, photographs, texts, trade names, trademarks, and any other identifying elements — is the exclusive property of CVPidClub or its licensors, protected under Spanish and international intellectual property law.

Reproduction, distribution, public communication, transformation, or any other form of exploitation of such content without prior written authorisation from CVPidClub is strictly prohibited and may result in legal action.

10. DATA PROTECTION

Personal data collected during the purchase process is governed by our Privacy Policy, in compliance with EU Regulation 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).

11. COOKIES

Cookie usage on this website is governed by our Cookie Policy, in compliance with applicable Spanish and EU regulations.

12. DISPUTE RESOLUTION AND JURISDICTION

These Terms and Conditions are governed by Spanish law. For any dispute arising from the interpretation, performance, or enforcement of this contract, the parties — expressly waiving any other jurisdiction that may apply — submit to the courts of Vigo, Spain.

Notwithstanding the above, if the customer is a consumer, the consumer protection regulations most favourable to them shall apply, and they may access the EU Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr

13. SEVERABILITY

If any clause of these Terms and Conditions is found to be null or unenforceable, such nullity shall not affect the remainder of the document, which shall remain fully in force.
